The Celtics guard, who then boarded a flight to join the team for last night’s game against the Rockets, was given a preliminary hearing date of Jan. 17, though attorney Michael Zazlavsky was able to have Allen’s appearance for that hearing waived. The process now enters the discovery phase. “I expect that the jury, after hearing evidence, will see that Tony is innocent,” Zazlavsky said. A surveillance tape which allegedly recorded Allen throwing punches in an Aug. 28 incident looms as a key piece of evidence for the prosecution. Though Zazlavsky has seen the tape, he declined comment. Allen, who hurried directly from the airport to the Toyota Center last night, was particularly grateful for Zazlavsky’s ability to have his appearance at the Jan. 17 hearing waived. “I can focus now, just focus on basketball,” said Allen, who also reported that his sore right knee is feeling better. He even managed to get in some shooting around with friends in Chicago. “I played with some local guys,” he said. “Sort of a king of the court thing — all jump shots.
