都講到了《世界人權宣言》第十六條，

怎麼能不講到《公民權利和政治權利國際公約》第二十三條

以及超著名的聯合國人權委員會上訴案

Joslin v. New Zealand, Communication No 902/1999 呢？

該聯合國自己的人權委員會委員，英文程度應該比我們要好很多吧？



先來認識《公民權利和政治權利國際公約》裡頭在講什麼。

該公約 23 條是這樣說 der：

1. The family is the natural and fundamental group unit of
   society and is entitled to protection by society and the
   State.

2. The right of men and women of marriageable age to marry
   and to found a family shall be recognized.

3. No marriage shall be entered into without the free and
   full consent of the intending spouses.

4. States Parties to the present Covenant shall take
   appropriate steps to ensure equality of rights and
   responsibilities of spouses as to marriage, during
   marriage and at its dissolution. In the case of
   dissolution, provision shall be made for the necessary
   protection of any children.

基本上關鍵部分所用的字句，和《人權宣言》16 條用的，

可說幾乎一模一樣。



而中文版則是這樣 der：

一 家庭為社會之自然基本團體單位，應受社會及國家之保護。

二 男女已達結婚年齡者，其結婚及成立家庭之權利應予確認。

三 婚姻非經婚嫁雙方自由完全同意，不得締結。

四 本公約締約國應採取適當步驟，確保夫妻在婚姻方面，在婚
   姻關係存續期間，以及在婚姻關係消滅時，雙方權利責任平
   等。婚姻關係消滅時，應訂定辦法，對子女予以必要之保護。

阿，再補充一下，此公約已經國內法化了，大家知道吧？

「我國早在仍為聯合國會員國之 1967 年，即以中華民國名義簽署了「
公民與政治權利國際公約」（ICCPR）及「經濟社會文化權利國際公約」
（ICESCR），為原始簽署國之一。然因國際與國內政治因素，遲至 2009
年 3 月 31 日，立法院始批准兩公約及「公民與政治權利國際公約及經
濟社會文化權利國際公約施行法」；馬英九總統於是年 5 月 14 日公佈
後，即於 12 月 10 日世界人權日正式生效，至此始完成國內法化程序。
由於施行法第 2條規定，兩公約所揭示保障人權之規定具有國內法律之效
力，明確將兩公約與國內法接軌，得為所有民眾與執法者直接適用，故不
致產生兩公約雖具國內法效力，但位階過低的問題。」

現在可以講到此判決了，故事發生在紐西蘭。紐西蘭的法律是不接納同性

婚姻的，所以就有幾個女女（其中一位就是 Juliet Joslin，案名來源）

上訴到聯合國人權委員會（因紐西蘭有簽署公約），說該國法案侵犯到她

們的人權，請聯合國為她們申冤～～


聯合國人權委員會在 2002 年做出判決，其中關鍵字句如下：

“Article 23, paragraph 2, of the Covenant is the only
substantive provision in the Covenant which defines a right by
using the term "men and women", rather than "every human being",
"everyone" and "all persons". Use of the term "men and women",
rather than the general terms used elsewhere in Part III of the
Covenant, has been consistently and uniformly understood as
indicating that the treaty obligation of States parties stemming
from article 23, paragraph 2, of the Covenant is to recognize as
marriage only the union between a man and a woman wishing to
marry each other.”

「公約第二十三條第二款，是公約中唯一使用「男人與女人」此詞彙來定
義權利的條款，而非使用「每個人類」、「每一個人」或「所有人」。使
用「男人與女人」，而非如公約第三編中其他一般性詞彙，已一致且廣泛
地被了解為基於公約第二十三條第二款，締約國的義務是將婚姻只視為一
個男人和一個女人彼此同意結婚之結合。」


判決結論：

“In light of the scope of the right to marry under article 23,
paragraph 2, of the Covenant, the Committee cannot find that by
mere refusal to provide for marriage between homosexual couples,
the State party has violated the rights of the authors under
articles 16, 17, 23, paragraphs 1 and 2, or 26 of the Covenant.”



人家聯合國人權委員會都出來當英文老師了

認為從以前到現在在公約裡婚姻的定義，就被看成是一男一女的結合

挺同者若還要把公約拿出來為自己站台，還是去洗洗睡吧～
