In the Makefile of the xf86-video-ati port is a line with something like: if $OSVERSION < 100000 | !WITH_NEW_XORG | !i386 | !amd64 then WITH_NEW_XORG=off endif So this port will never compile the new version of the driver on 9-STABLE. If you remove the $OSVERSION < 100000 part it will compile and work correctly.
