【重視外勞貢獻,保障外勞人權】聲明
STATEMENT FOR DECEMBER 28, 2003
【Recognize migrants’ contributions; Protect migrants’ human rights】
自一九八零年代中期,台灣資本家為降低勞動成本開始陸續僱用外籍勞工,並逐漸
成為普遍現象;一九九二年在資本家的要求下,台灣政府通過「就業服務法」正式
引進外籍勞工,十幾年來外勞來台人次已超過三百萬人,並成為台灣營造業、製造
業、家事服務業重要的勞動力。
Since mid 1980s, in order to reduce the labor cost in Taiwan. Capitalists
started to hire migrant workers and this practice gradually became common.
In1992, in order to satisfy the requests of capitalists, the Taiwan
Government approved the “Employment and Service Act” and legalized the
importation of migrant workers. Within these decades, there have been more
than 3,000,000 migrants who had arrived and worked in Taiwan. They have
become the important labor force in the construction, manufacturing and
the domestic labor sectors.
儘管從表面現象來看,引進外勞加劇台灣工人失業的嚴重性;但是這樣的責難不應
由個別的外籍勞工承擔,若要歸咎,應該是政府引進外勞的政策責任。
Observing from the surface of the phenomenon, it seems that the importation
of the migrant workers increases the unemployment rate of the local workers.
But this problem should not be attributed to the migrants but instead should
be blamed to the migrant policies of the government.
事實上,被當成廉價勞工的外勞,因為勞委會的外勞政策與外勞行政弊端叢生,在
勞僱關係中處於完全被宰制的位置,其弱勢處境更甚於本地勞工;而他/她們做為
勞動者,也如同本地勞工一樣,對台灣社會付出極大的貢獻!
Actually, due to the growing deficiencies as reflected in the migrant
policies of the government, migrant workers known as the cheap labor are
extremely exploited in the employment relationship between the foreign
workers and the employers. Being a minority in Taiwan their condition is
worse than the local workers. However, as workers they contribute equally
along with the local workers to the development of Taiwan society.
●在高危險的、粗重的、污染性的製造業工廠,外勞是主要的勞動者,他/她們承擔
職業災害的風險,為台灣社會維持勞力密集的製造業部門生產!
●The migrant workers are the main forces among the 3D (dangerous, dirty
and difficult) manufacturing sectors, risking occupational injury while
maintaining the labor extensive industries of Taiwan.
●而近幾年來重大的營造業工程,如台北/高雄捷運、台灣高鐵、台北101大樓等帶
給台灣社會進步與繁榮的建設,幾乎都有外籍勞工的勞動血汗!
●Migrant workers contributed their sweat and blood in the construction
of important infrastructure projects such as Taipei-Kaohsiung high-speed
railway, Taipei & Kaohsiung MRT systems, the world tallest building Taipei
101 Mall, CKS II airport, major highways to mention a few.
●再者,由於台灣社會福利制度不完備,越來越多的個別家庭難以負擔老年人、病
患及幼兒的照顧責任,大量女性外勞來台擔任監護工、家庭幫傭,填補了社會福利
的漏洞,代替台灣子女善盡孝道!
●Furthermore, based on the deficient social welfare system in Taiwan,
more and more families become not capable of taking care of their own
elders, patients and kids. Large number of female migrant workers had
come, as the care-takers and domestic helpers, to fill the holes in
its coat and show filial obedience to the parents for their Taiwanese
children.
我們希望台灣社會在享用舒適的捷運、驕傲於台北101大樓成為世界最高建築,以
及減輕家中老小照顧責任的同時,能夠看見外勞對台灣社會的貢獻,並給予平等
對待及尊重!
We hope when people enjoy the convenience of MRT, being proud of the
highest building Taipei 101, and being delighted the burden of taking
care of family elders and kids, they remember to recognize the
contributions of migrant worker and offer them respect and just treatment.
根據聯合國世界人權宣言,我們特別要求台灣政府落實外勞的基本人權保障:
According to the ‘Universal Declaration of Human Rights’ (UDHR) of
United Nations, we respectfully demand the Taiwan government to implement
concretely the protection of the migrant workers’ basic human rights:
一、 全面檢討外勞引進制度,保障外勞享有自由轉換雇主的權利(世界人權宣言§23)
1. Evaluate thoroughly the migrant importation system in order to protect
the rights of free choice of employment of the migrant workers. (UDHR §23)
二、 取消人口販賣式現行仲介制度,於勞委會下成立「外勞事務局」,落實國與國
直接聘僱政策,杜絕勞動剝削。(世界人權宣言§4)
2. Abolish the existing slave-trade manpower system. Establish ‘Migrant
Labor Affair Bureau’ under CLA and concretize the direct/country-to-country
hiring policy in order to stamp out the exploitation from the manpower
agencies and brokers. (UDHR §4)
三、 保障外勞享有休息及閒暇的權利(世界人權宣言§24)
3. Protect the rights of rest and leisure of the migrant workers. (UDHR §24)
四、反對廉價外勞政策,保障外勞享有同工同酬的權利。(世界人權宣言§23)
4. Act against the cheap-migrant worker policies in order to protect the
right of equal pay for equal work of the migrant workers. (UDHR §23)
