xiah俊秀,hero在中,micky有天事實上明確表示退出東方神
起的意思，並已著手進行解散程序。

國內最大經紀公司sm entertainment於1日凌晨，透過報導
資料表達了"會努力進行補救"，但是實為不如意的展望。

如此看來，三名成員和sm之間到底有過怎樣的紛爭？解決
本次事件的關鍵，就存在該紛爭當中。透過電話訪問了xiah
俊秀等三名成員的法律代理人李相赫(音譯)律師，內容如下：



－紛爭的最主要核心為何?
主要是不合理的專屬契約，根據最近公正交易委員會推行的
標準條款，最長契約期間不得超過七年，當然必須從練習生
時期開始提拔培養的歌手的狀況，常會有例外發生的可能，
但是東方神起的情況裡，若以公正委所發表的標準條款加以
檢驗，則會發現許多各種不公平的層面。如此情況下在過遲
之前加以糾正是最大的目標。

－三位成員和他們的父母所投資的化妝品事業，據說也是紛
爭的一大主因？
心理層面上，或許是加深成員們紛爭的要因之一也不一定，
但並非針對化妝品事業的意見而導致訴訟。檢討過1日sm所發
表的正式立場新聞稿，導致了化妝品相關的話題全面性的浮
上檯面。認為成員們因為副業之一而如此的提出訴訟是誤解。

－三位成員的活動有全面中斷的危機，訴訟部分會於何時做
出結論？
首先提出專屬契約效力終止假處分的申請，再來則是專屬契
約不存在確認的訴訟，也想最大限度的盡快做出結論。在裁
定裡最重要的中間，可能會有許多變數，很難確定究竟哪時
才能完成，希望能在六個月內有所結論，並會為此而努力。

－勝訴的機率？
肯定性的來看，sm entertainment在過去曾多次收到公正委
所發出，違反公正委標準條款的糾正命令。東方神起就法則
上訴諸的部分，也因為沒有違反所以並無不利。

－訴諸法律之前，未曾嘗試與李秀滿先生或是所屬公司進行
協議？
口頭上表示會努力進行圓滿的處理，成員們也曾直接和所屬
公司方面進行面談，透過各種管道尋求解決。然而所屬公司
卻無視成員們的意見，只反覆採用既定的方針，結果還是只
能透過法律處理。成員們也對歌迷們感到十分抱歉。

－化妝品事業的紛爭癥結點為何？
難道不是所屬公司對於藝人和家族個人投資的事業表示不贊
同嗎？其他藝人也投資副業的事已經一般化了，甚至三名成
員在開始化妝品事業之前，和所屬公司的金永民代表也經歷
過協議過程，事後公司又提出不同說詞，似乎是感到很受傷。

－東方神起終究會踏上解散的過程嗎？
嘗試過了各種方式卻都無疾而終，所以才到了現在這個地步
。並不是採取息事寧人的低姿態。法律上的程序一結束，應
該就會有新的提案。五人一起以sm entertainment為基盤而
進行活動的部分，就現在情況而言，可以加以判斷是不太容
易的。

－記者會的計畫？
需要的話會召開，但目前還沒有計畫。現在成員們對歌迷們
感到最為抱歉，可能的話希望能夠安靜的度過。
