[問題] 請高手幫忙看看履約保證函的翻譯

We have been informed that our customer partA hereinafter called the seller
and your client s partB hereinafter called the buyer have entered into a
contract no. / purchase order no. XXXXXXXX on sale and purchase contract for
indonesia iron ore .the total value of usd3,540.000.00(the contract)

我們已經告知我們的客戶partA 以下簡稱賣家，以及你的客戶partB以下簡稱買家，訂定
一個 合約編號/訂購同意單編號:XXXXXXX的買賣合約書 於印尼的鐵礦 ，總金額為美金
354萬

We also understand that it has been agreed between you and the seller that
the later has to provide a bank guarantee in favor of the buyer.amounting to
2% of the monthly cargo value i.e. Usd cover due fulfillment of their
obligations resulting from the above contract in consideration of the
aforesaid.we,hereby irrevocably undertake to pay xxxxxxxxxxxx  coal
co.,ltd without delay the sum or totality sums up to the maximum of usd70,800
(seventy thousand eight hundred united states dollar) upon receipt of your
first demand in writing wherein you declare simultaneously that the
contractor/seller failed to meet his contractual obligations.

我們也了解"它"同意你跟賣家...從這邊開始我就看不太懂了>.<

Our liability under this guarantee will expire upon receipt of the buyer’s
written declaration that the contract / seller has fulfilled all tis
obligations under the contract,but whatsoever the latest validity date of
this guarantee is not later than 60 days from the lc issuance date.

這段我也不是很了解

This guarantee is issued in english in case of inconsistency.the english text
shall prevail.

這保證函是用英文發布 再不一致的情形下以英文原文正本為準 這是這樣翻沒錯嗎??

This bank guarantee is subject to the uniform customs and practices for
demand guarantees set forth by the icc.paris.france.and latest revision of
publication icc458.

這是在說這履約保證受到ICC的法律效益嗎??

This guarantee is not transferable and in the buyer’s favor only.

推 JarvisDamon:履約保證函PBG一般都是制式的格式 要注意PBG的效期
→ JarvisDamon:是否跟L/C的規定要求有關係 最重要的是受益人的信用
→ JarvisDamon:是不是會有惡意求償的可能性
