FIA president Max Mosley has won his legal case against the News of the World
and has been awarded ￡60,000 in damages.

FIA摸妳死打贏了隱私官司，獲得六萬英鎊的賠償。

The High Court ruled that the 68-year-old’s privacy was breached when the
British tabloid published a lurid expose about his sex life in March that
claimed he was involved in a “sick Nazi orgy with five hookers” in a
Chelsea flat.

高等法院判決，六十八歲他的性生活隱私被侵犯。這是在三月被刊出的新聞。

Mosley admitted taking part in sadomasochistic role-play with prostitutes,
but strongly denied the allegation that there were Nazi overtones to his
activities.

摸妳死承認完角色扮演，但並無納粹內容。

He chose to sue the newspaper on privacy grounds rather than for defamation,
but his lawyer James Price QC argued that the "indefensible intrusion" was
made worse by the false allegation that Mosley played a concentration camp
guard and an inmate.

他選擇要告報紙。

The presiding judge, Mr Justice Eady, ruled that Mosley had a "reasonable
expectation of privacy in relation to sexual activities, albeit
unconventional, carried on between consenting adults in private property" and
that there was no public interest involved in the News of the World's
revelations.

「正義」法官說，摸妳死有「正當」理由可以在私人財產上進行自己的性活動。
而報方並無權可以侵入，並將之刊出。

"There was bondage, beating and domination, which seem to be typical of S&M
behaviour," he said.

"But there was no public interest or other justification for the clandestine
recording, for the publication of the resulting information and still
photographs, or for the placing of the video extracts on the News of the
World website – all of this on a massive scale.

但這並不是大眾所有興趣的，不管是報紙大肆宣傳的照片影片等消息。

"Of course I accept that such behaviour is viewed by some people with
distaste and moral disapproval, but in the light of modern rights-based
jurisprudence, that does not provide any justification for the intrusion on
the personal privacy of the claimant."

「當然，有些人或不喜歡這樣的行為，但這又不犯法。」

The judge also said the newspaper had failed to substantiate its claim that
Mosley's activities had any Nazi connotations.

法官也說報方沒有提出有力證據，證明摸妳死有介入任何納粹活動。

"I have found no evidence that the gathering on 28 March 2008 was intended to
be an enactment of Nazi behaviour or adoption of any of its attitudes," he
said.
「我找不到三月二十八日的活動跟納粹活動精神有關。」

"Nor was it in fact.

「事實就是這樣。」

"I see no genuine basis at all for the suggestion that the participants
mocked the victims of the Holocaust."

「我也看不到在這當中的參與成員想要嘲笑並侮辱Holocaust的受害者。」
