許多美國法律專家堅信﹐關於突擊隊在巴基斯坦展開突襲殺死烏薩馬‧本‧拉登（Osama
bin Laden）的行動、以及近幾年對基地組織海外成員實施的類似行動﹐白宮擁有堅實的
法律基礎。

法學教授和軍事行動專家們一致將2001年9‧11恐怖襲擊後不久國會通過的一項法律作為
法理依據：授權使用武力決議（Authorization for Use of Military Force）。

根據該法律﹐只要總統認為誰是協助過2001年恐怖襲擊的國家、組織和個人﹐總統就可以
針對其使用一切必要及適當的武力。決議認為這一行動是正當的理由是它屬於自我防衛﹐
旨在防止今後有任何針對美國的國際恐怖主義行為。

研究軍事行動的法學專家說﹐該決議適用於此次對本‧拉登在巴基斯坦藏身地的襲擊這樣
的軍事行動﹐也適用於過去對基地組織海外活動的突襲。

occurred on September 11, 2001, or harbored such organizations or persons,

in order to prevent any future acts of international terrorism against 

the United States by such nations, organizations or persons.

兩者授權都提供了相當大的彈性：

acting nationally or through regional organizations or arrangements,

and acting in cooperation with the Secretary-General,

to take all necessary measures, notwithstanding paragraph 9 of resolution 1970

 (2011), to protect civilians and civilian populated areas under threat of

attack in the Libyan Arab Jamahiriya, including Benghazi, while excluding a

foreign occupation force of any form on any part of Libyan territory, and

requests the Member States concerned to inform the Secretary-General

immediately of the measures they take pursuant to the authorization conferred

by this paragraph which shall be immediately reported to the Security Council.
