Jackson in his mega-selling 1992 anthem for change.

Now the singer's estate and Jackson's mother could use a little healing
themselves as they fight each other over the non-profit Heal the World
Foundation, which claims it's the successor to the pop star's defunct charity
inspired by the song. At stake in the skirmish are trademarks worth millions
of dollars and a piece of Jackson's legacy.

The foundation's director, Melissa Johnson, claims the pop singer handed her

from the Jackson family itself.

likeness rights and numerous trademarks and copyrights that have been used to
market new products since his June 2009 death.

"Please do not believe them. It's not true."

Complicating Katherine Jackson's involvement with the foundation is her
business relationship with Howard Mann, a businessman who obtained some of
Jackson's recordings years ago. Mann, who is paying to defend Heal the World
in court, is also being sued by the estate in a separate lawsuit that accuses
him of infringing on estate copyrights.

Since Mann's involvement in the Heal the World lawsuit, several former

criminal defense team and now represents Jackson family patriarch Joe
Jackson, and the singer's former manager and spokeswoman Raymone Bain. Bain
sued Jackson before his death for $44 million dollars, claiming she was cut
out of her share of the deal for the singer's planned series of comeback
concerts titled "This Is It."

foundation to Johnson in 2005, but estate attorneys have cast doubt on the
statement and say Oxman's name was never mentioned in years of correspondence
from Johnson to Jackson's attorneys and representatives.

have some legitimacy.

years, Johnson has not received a salary for her work on Heal the World

In the meantime the estate has worked to repair major financial damage
incurred by Michael Jackson during his lifetime. The "Thriller" singer died

a half of litigation, unchanged," the estate's attorney's wrote in a trial
brief. "Defendants have infringed and will continue to infringe on (the

the fullest extent they are able to do so."

最近這個新聞似乎在國外論壇吵得沸沸揚揚 看到MJJC有人貼了一個blog
講述了Howard Mann和HTWF怎麼和J媽扯上關係的前因後果 文章很長 我節錄一下重點
可以讓大家更了解這一團混亂 首先先來基本人物介紹一下
Howard Mann就是跟J媽合作Never can say goodbye和其他一堆有的沒有網站的合夥人
Melissa Johnson是那個跟MJ沒關係的HTWF的創辦者
Henry Vaccaro 是多年前拿到一堆傑克森家族物品的人 幾年前把東西都賣給Howard Mann

首先 Howard Mann怎麼拿到MJ家族的物品

傑克森家族把他們的許多家族相關紀念物品存在倉庫中 用的是Tito的名字 但是是由J媽
每個月支付650美金的倉庫租金 倉庫裡面包括傑克森家族用過的表演服裝 夢幻莊園的
契約 私人照片 J5的表演錄影 MJ的鉛筆畫 MJ未發行的demo帶 MJ戰慄專輯和其他專輯的
金唱片還有其他多個獎項 MJ密封的相關法律文件 歌迷的信 MJ的私人醫療紀錄等等
這些東西本來是準備用在傑克森家族博物館

1991年 傑克森家族公司成立 組織者是Jermain 他打算開傑克森家族主題餐聽 同時打算
在紐澤西建造一個娛樂中心

92年 Henry Vaccaro的公司Kramer Guitar破產 傑克森家族公司簽了合約打算花一百五十
萬買下這個公司

94年傑克森家族公司關閉

94年 Kramer Guitar控告並且贏了官司 傑克森家族應該賠償他一百五十萬但是傑克森家
族聲稱他們付不出錢 因為他們沒有資產  告訴中控告了傑克森家族八個人 但MJ Janet和
LaToya不在控訴中 Vaccaro聲稱J家只付了他一百五十萬中的20萬

98年 在Vaccaro贏得官司四年後 Vaccaro找了私家偵探調查J家到底有多少資產
發現 J家老家有勞斯萊斯汽車停在家裡

98年九月 聯邦警察從J家老家扣押了一台1984年的勞斯萊斯

98年聯邦警察重回J家老家 沒收了另一輛勞斯萊斯 並且還有一個MJ用來創作Thriller專
輯的鋼琴 因為MJ不在控告名單 所以鋼琴的沒收是非法的

整個老家價值還不到欠Vaccaro的資金 所有他想了別的主意

那個私家偵探 給J家成員發了50塊回扣的支票 有三個J家人真的去兌現了
這讓那個私家偵探得知 到底是哪些銀行帳號兌現了這些支票 Vaccaro的律師發了傳票給這
些銀行帳戶 其中一個帳戶就是J媽的 Vaccaro方同時知道每個月都會有個650美金的支票
開出

所以他們去了這個每個月支票都會兌現的地址 而他們發現了那個倉庫保有傑克森家族的
多年紀念物品

99年一月 聯邦警差扣押了這些倉庫

99年二月 Jermaine宣告破產

99年二月 Tito也宣告破產

99年三月 J媽和J爸都宣告破產

從J家老家扣押的資產還有倉庫的資產 必須回到處理破產的法院中

Vacarro說 當我們拿到手這麼多東西 卻必須繳回去 我很沮喪

99年MJ提出 他願意出兩萬美金買回其中一台勞斯萊斯和他的鋼琴

99年12月 Vaccaro提出抗議說把東西賣給MJ不行 因為法院應該要確保賣出的價格越高
越好 法官同意 所以MJ想要買回的條件被拒絕 但MJ的律師成功的說服 法院拍賣這兩台
勞斯萊斯時不能說這兩輛車是MJ所有

2000年四月 法官下令把那些存有J家紀念物品的貨櫃拍賣

法院為了J家找了托管人 J家的人說倉庫內的物品價值兩萬美金 而倉庫租借費是五萬
託管人提出如果傑克森家族支付了租借費 倉庫內的物品就歸還 傑克森家族成員無法決定
誰要來付這些錢 甚至找來調解員想要解決這個問題 但沒有達成協議 就錯失了把東西拿回
來的機會

這是全世界最大的MJ私人物品收藏 有很多來往的私密信件 其中像是有一封信是老喬寫給
勝利巡迴專刊的製作人 他准許他們使用他兒子們的照片 但是要他們把他兒子的膚色調白
20-30% 還有一封J媽寫給耶和華見證人教會的信 表達她對於他們把MJ從教會開除很不滿

Vaccaro說 他們居然會把這些這麼私人的東西給陌生人實在太瘋狂了

2001年 12月託管人告知法院 他將拍賣這些倉庫

01年12月 Vaccaro並不知道這些東西將被出售 並且要律師打電話想要回這些東西 說他
已經對J家族徹底厭倦了

託管人告訴Vacaro的律師這個拍賣 並表示如果Vaccaro願意付八萬五千美金 包含六萬的
儲藏費和兩萬五的法律費用 他就能讓法院釋放這些東西 而Vaccaro付了這些錢

法院要求要看有沒有更高的出價人

2002年一月 Vaccaro是唯一的出價人 他發現裡面的東西包含了MJ和Janet的

他開設了一個付費可看的網站叫做Vintage Pop Media 裡面展示了J家的物品 包括MJ的
還有MJ的照片 而且他打算拍賣這些東西

2004年MJ控告Vaccaro和這個網站 MJ的訴書請進上篇原網站看

MJ指控了這個網站剝削他的權利 和侵犯了他的隱私權


法院後來下令 只有J家破產的人的相關物品才能被轉移出售 而其他人包括Janet和MJ的
東西不能被轉讓
MJ的律師表示 MJ對於有人想要賣掉他的私人物品感到非常火大 他們會嘗試一切手段
把東西拿回來


04年三月 Vaccaro聲稱他把所有東西賣給歐洲的買家

04年三月 Diane Dimond告訴Tom Sneddon這些東西裡面有些非常有意思的東 TS要求把
裡面的東西交到聖塔芭芭拉的檢察官手中

04年三月 Vaccaro要脅MJ

Vaccaro說 我到地獄都會繼續奮戰 如果他這樣做來改善他的形象 來阿 或許全世界將知道
我們在這些東西中找到了些甚麼跟性有關的東西

04年四月 法院發出 臨時禁止令 Vaccaro不准賣出任何MJ的私人物品 和使用他的肖像權

05年 Vacarro寫信給TS說他相信 MJ和Janet控告他的原因是因為這些物品中有不利於MJ
性騷擾孩童案件的東西

05年 Vaccaro訴請要拿回這些東西 而且贏得了案子

06年 MJ被宣告無罪後去了巴林 太多事發生 MJ沒有出席給法院證詞 還有也沒在支付他的
律師費 Vaccaro贏了MJ對他控告的訴訟 並且導致MJ無法就同一件事情控告兩次

06年 Vacarro宣稱他把東西都賣給了 Universal Express

07年五月 Universal Express打算舉辦拍賣會賣出這些東西

MJ發言人表示 MJ不知道這件事情 而他現在對於他的東西要被拍賣非常傷心

07年五月 Universal Express威脅MJ 如果MJ提出告訴 他就會放出有危害的東西 並且說
他打算賣出MJ沒有發行的音樂給SONY 但MJ的律師警告 這些音樂是有受到著作權保護

Universal Express聲明 他們有MJ所畫的裸體男孩畫像 還有他的漂白霜 還有情趣用品
還有很多他的密封法律文件 我們沒有放在拍賣會是出自對MJ的尊敬 他有他的麻煩 我們都
有自己的秘密 但如果MJ沒有搞出這一團亂 我就會保持沉默會偷偷把這些東西還他 我是個
紳士 但是他把我惹毛了 我最後會把他全拿出來拍賣

MJ最後和Universal Express達成協議 MJ同意讓拍賣會進行 而他們會把MJ和Janet想要的
某些物品還給他們

MJ的發言人表示 MJ對協議感到滿意

07年六月 Universal Express食言 打算把原來要還給MJ和Janet的東西拍賣 法院判
MJ和Janet贏的案子

07年八月  這家公司老闆被起訴多項罪狀 公司也被清算了

Vaccaro沒有從這家公司得到應該有的金錢 所以他被判獲得剩下還沒拍賣的東西

2009年 在MJ死後 Vaccaro聲稱那些他應該要還給MJ的東西被偷了 而他把其他所有東西全
拿來出售

Howard Mann知道最有價值的東西並不是那些傑克森家族的東西 而是法院之前的判決 在
2006年的MJ的訴訟中因為MJ沒有出庭作證而被駁回 所以這個MJ之前告過的公司 就有永遠
不被MJ和他孩子們再次控告的免責權 這家Vintage Pop就能自由的剝削MJ的肖像權和名字
Howard Mann從Vaccaro手中買下這家公司後轉向J媽站到他這邊 來販賣東西給歌迷

Michael Jackson's estate reached a settlement Tuesday that ended its lengthy
fight with a nonprofit that claimed it was the successor to the singer's Heal
the World charity.

In a statement, Jackson's estate said the settlement calls for it to retain
the rights to the Heal the World charity and rights to any trademarks the
current foundation held.

Her attorney, Edgar Pease, did not immediately return a phone message seeking
comment Tuesday.

between the Michael Jackson Estate and the Heal the World defendants are
wrong. The Estate is taking back the Heal the World Foundation and all of the

owns the Heal the World name, and neither Melissa Johnson nor her companies
will ever be able to use Michael Jackson's name or the Heal the World name.

而遺產公司會重開MJ的HTWF然後和現有的這個合併

那個寫樂評書的作者 說是去查了相關的事情 說他得知的消息是
Mann不會再跟HTWF有關聯 HTWF的委員會還沒選也還沒產生
遺產公司和Johnson之間的細節仍再協商 遺產公司和J媽將共同監控這個基金會

Mann則說Johnson仍是在HTWF的委員會裡 誰說的是真的 那就靜觀其變了

老實說HTWF如果想要建立信譽 最好還是Johnson給踢掉吧 = =
不過不知道遺產公司到底拿了甚麼做交換 可能也不是想踢就踢的掉的

(21-4-2011) MJFC received the following statement just moments ago from the
Michael Jackson Estate:

Please let the fans know that we are aware of the many questions from the fan
community regarding the recent settlement of the HTWF lawsuit. The Estate
will need at least ninety days to gather information, as well as all of the
property that will be coming back to the Estate from Melissa Johnson and the
HTWF. We want the fans to rest assured that all decisions on the use of a
charitable foundation or, as an alternative, making direct contributions to
recipient charities, and any and all personnel decisions, will be made with
complete regard to Michael’s wishes and Michael’s legacy, which we intend
to honor and perpetuate. We also value the opinions of Michael’s fans who,
above all, have shown unwavering support for Michael and his legacy.  We
therefore want to assure the fans that all actions being taken by the Estate,
past, present and future, will be guided by the paramount objective of doing
the right thing by Michael.

我們知道歌迷們對於我們和HTWF的和解有很多的疑問 遺產公司需要至少90天來蒐集相關
訊息 還有有多少東西會從HTWF還有Malissa Johnson手中回到遺產公司 我們想要讓歌迷知
