1. 延期的要求被拒絕, 不過法官作了幾個對檢方有利的判決
District Judge Terry Ruckriegle said Friday that he has denied a request
from prosecutors to delay the trial against NBA star Kobe Bryant.
Ruckriegle said there was no reason to postpone the trial, but he did side
with the prosecution on two other issues relating to the woman's medical his-
tory and her previous use of drugs and alcohol.
In the first ruling, the judge denied defense requests to admit evidence
about two purported suicide attempts by the victim before her encounter with
Bryant and about her use of any prescription medications.
The second issue, which was granted by Ruckriegle, dealt with the prosecu-
tion's requests to limit testimony about the woman's medical and mental health
history and any drug and alcohol use.
2. 檢方和辯方各自出招
(1) 辯方
Kobe Bryant's defence team says it will be ready to go to trial Aug. 27 and
argues in a new court filing that delaying the case indefinitely, as the prose-
cution wants, would be too difficult and too costly.
In a filing made public Friday, defence lawyers also claimed that by filing
a civil lawsuit this week, Bryant's 20-year-old accuser revealed "her motiva-
tion to pursue her false accusation - the hope of a large monetary award."
對於檢方對法官近來的指控還有對陪審團的質疑, Pamela Mackey 有如下的回應:
"Other recent information has also been printed which may be even more
damaging to the prosecution's case: specifically, the accuser's filing of a
civil suit, thereby exposing her motivation to pursue her false accusation -
the hope of a large monetary award," defence lawyer Pamela Mackey wrote.
"If an impartial jury cannot be impaneled, solutions to that problem will
have to be found," Mackey wrote. "It is premature to assume that the citizens
of Eagle County cannot be fair to the prosecution in this matter."
(2) 檢方和女子的律師
Prosecutors and the woman accusing Kobe Bryant of rape are asking the judge
to ease a gag order so they can respond to a wildly publicized evidence they
say is favorable to the NBA star.
"Unrebutted, this 'garbage' is allowed to be elevated in the mind of the
public to the underserved status of fact," the woman's attorneys wrote in a
court filing.
