Mary works for an environmental group and her partner is an artist. They have worked very hard to afford this apartment worthy of 320,000 dollars. Their apartment is on the 7th floor and everyday they have enjoued a aplendid view of the river and a public green park between their building and the river. One day, however, they found out that a construction company, Stanley's,Inc. from Illinois, contracted with New York City Government, started destroying the green park and when asked why, the company manager replied that the City government has decided that the green park would be replaced with a 20-floor community college owned by the City but run by the Sanford's, a family that also owns another college in upper Manhattan. With surprise and anger, Mary and her partner went to talk to a lawyer and plan to sue, but with a worry that they might not be able to afford litigation. If you were the lawyer, how would you advice to them? Based upon what you have learnt so far, please write a litigation plan for Mary and her partner. Which party they are going to sue against? To which court? On what accounts? Could they maje appeals? If they lose in all of the lower courts, could you take them tto the United States Supreme Court? Why or why not?
