1. In modern regulatory states, the violation of statutory requirements
may have profound impacts on the assesment of liability. Please sketch
the relationship between statutory violations and the establishment of
negligence in the light of the cases that we discussed in the case.

2. In the modern economy, individuals are encourage to make decisions and
bear consequences. Tort law, however, intervenes and reallocates the
consequences of individual decisions by assigning liability to responsible
parties. In this connection, decision-making and imformation flow have
been identified as critical elements in allocating liability. Please
further elaborate this point by reference to cases we coverd in the class.

3. Proportionality and all-or-nothing are two extreme positions in negligence
and causation articulation. Please analyze how torts began to cross the
boundary and come up with innovative solutions in light of the cases you
read in the class.(30%)
