Each case is different in size. Big ones can be 10 to 20 pages. Small ones are only 5 or 6 pages. This semester is unique because the class is only about 50 people and attending rate is roughly 70 percent. It is said in previous semester, the class was more than 100 people. Professor Yeh’s teaching style in this class is very special. Sometimes he assigns cases to students. Sometimes he just asks if any student volunteers to present the case (facts, judgment, and reasoning). When students are presenting, he is very encouraging. Compared with other law subject, tort law is not very complicated. Maybe it’s because professor Yeh doesn’t emphasize detailed doctrinal analysis. Instead professor talks about the background of the case and the policy preference. Furthermore, some pollution cases are discussed, like asbestos(石 棉) and Agent Orange(橙色落葉劑). Some product liability cases are also dealt with, such as DES (miscarriage prevention medicine), oral contraceptive, and oral polio vaccine(口服小兒麻痺疫苗). These cases broaden my view. This class needs preparation for the case if you want to talk in class, which is good practice of English and legal reasoning. Usually I spent about 3 hours for about 20 pages (two cases) per week. The final exam is not so difficult. You need to grab the main ideas of the cases and cite the correct cases. Don’t worry about the detailed doctrines.
